GUEST’S WAIVER, RELEASE, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

The Mountain Mermaid and Bill Buerge - 20421, 2022, and 20416 Callon Drive, Topanga, CA 90290 (“the premises”)

Guest, or guest’s legal guardian, must agree to this waiver and release in its entirety prior to residing at the premises and, or participating in any activity while on the premises. By purchasing a reservation at the premises, you are agreeing to relieve the premises, and Bill Buerge, all affiliated individuals and entities, now and forever of liability for personal injury, wrongful death and/or property damage.

The premises are located in a natural rural environment that has many hazards. Due to the carefully preserved natural environment within and around the property there are many man-made and natural hazards such as hilly and steep terrains, natural ravines, swimming pools, water features, ice plunges, insects, poisonous snakes and spiders, loose rocks and boulders, unlit and uneven paths and stairs, fireplace smoke, wildfires and floods, etc. that requires extra vigilance and precaution on and around the premises. In consideration of the permission granted by Bill Buerge to accept the guest in any activity on the premises, the guest hereby agrees to release and hold harmless Bill Buerge. The guest waives and relinquishes any and all claims, liability, cause of action, damages, or costs for wrongful death, personal injury and/or property damage that occurs on the premises.

The guest acknowledges that they have been fully advised of the risks and potential dangers incidental to the use of the premises and of engaging in the activity for which this release and registration is submitted, and voluntarily and knowingly assume the risks of use of the premises and of engaging in any activity on the premises. Further, the guest agrees to hold Bill Buerge, and all affiliated individuals and entities harmless in the event of any claim or action related to guest’s activity at or related to the premises, including the payment of any attorney’s fees and court costs related to such claim or action.

Accommodation sales are only refundable within 7 days of purchase. After 7 days, sales are final. Within 7 days of the retreat, all sales are final.

There is a strict "no pets allowed on site" policy.
